These Terms and Conditions are addressed both to Consumers and to Entrepreneurs using the Store and define the rules for using the Store as well as the rules and procedure for concluding Distance Sales Agreements via the Store.
Available card payment methods: Visa, Visa Electron, Mastercard, Mastercard Electronic, Maestro.

- Consumer – a natural person concluding an agreement with the Seller not directly related to their business or professional activity.

- Customer – any person or entity making purchases in the Store.
- Entrepreneur – an entity conducting business activity using the Store on its own behalf.
- Distance contract – a contract concluded without the simultaneous physical presence of the parties using means of remote communication.
- Terms – these Terms and Conditions of the Store.
- Order – the Customer’s declaration of intent submitted via the Order Form aiming to conclude a Sales Agreement.
- Account – the customer's account in the Store where data and order information are stored.
- Registration form – the form enabling the creation of an Account.
- Order form – an interactive form used to place an Order, add products to the cart and specify delivery and payment conditions.
- Cart – part of the store showing selected products and allowing modification of the Order.
- Product – a movable item or service offered in the Store.
- Sales Agreement – a sales agreement concluded between the Customer and the Seller via the Store.

- Telephone contact is available on business days from 9:00 AM to 5:00 PM.
- Technical requirements To use the Store you need:
- a device with Internet access and a web browser,
- an active e‑mail account,
- cookies enabled,
- Flash Player installed (if required by Store features).
- General information
- The Seller is not liable to the fullest extent permitted by law for interruptions in the Store’s operation caused by force majeure, actions of third parties or incompatibility with the Customer’s technical infrastructure.
- Browsing the offer does not require creating an Account. Orders can be placed after logging in or by providing necessary data for order fulfillment without registration.
- Prices in the Store are given in Polish zlotys (PLN) and are gross prices (including VAT).
- The final amount payable is increased by the delivery cost; delivery cost information is provided during order placement.
- For recurring contracts the final price includes all payments for the given billing period.
- If the final price cannot be determined in advance, the method of its calculation and information about additional fees will be provided in the Product description.
- Order placement rules To place an Order you must:
- optionally log in to the Store;
- select a Product and add it to the cart;
- fill in the Order Form providing recipient data, delivery address, shipment type and invoicing data if different;
- confirm the order by the “Order and pay” button (and possibly confirm via a link sent by e‑mail);
- choose a payment method and make the payment within the required time, subject to §9.
- Available delivery/collection methods:
- postal shipment,
- courier shipment.
- Available payment methods:
- bank transfer to the Seller’s account,
- electronic payments,
- payment by payment card.

- Performance of the sales agreement
- The Sales Agreement is concluded after placing an Order using the Order Form.
- After placing the Order the Seller immediately confirms its receipt and acceptance for processing by e‑mail to the Customer’s provided address. At the moment of receiving this message the Sales Agreement is concluded.
- In case of payment by bank transfer, electronic payment or card, the Customer is obliged to make the payment within 1 day from conclusion of the Agreement; otherwise the order will be cancelled.
- The Product is shipped within the time indicated in the Product description, subject to provisions regarding the commencement of fulfillment. Delivery time is 5-10 business days.
- The delivery time is counted from the date the Seller’s bank account is credited in case of payment by transfer, electronic means or card. In case of personal pickup the term is according to the Product description; the Customer will be informed by e‑mail when the product is ready for pickup.
- Delivery of products is carried out only within Poland.
- Right of withdrawal from the contract
- A Consumer has the right to withdraw from the Sales Agreement within 14 days without giving a reason, unless the contract concerns a product excluded from the right of withdrawal.
- The 14‑day period starts from the day the Consumer or a third party indicated by them receives the Product.
- For orders consisting of multiple parts, the term runs from receipt of the last part.
- Withdrawal may be submitted by regular mail, fax or electronically to the Seller’s e‑mail (sklep@toonfig.com) or via the form available from the Seller. Send the statement before expiry of the deadline to preserve the term.
- After sending the statement electronically the Seller will immediately confirm its receipt by e‑mail.
- If the Consumer withdraws from the contract the Seller returns all received payments without undue delay, no later than within 14 days from receipt of the withdrawal statement. The refund includes the cost of delivering the goods, except for additional costs resulting from the Consumer choosing a delivery method other than the cheapest ordinary method offered by the Seller.
- The refund is made using the same payment methods, unless the Consumer agrees to another solution without extra costs.
- The Seller may withhold the refund until receipt of the returned Product or proof of its shipment.
- The Consumer should return the Product to the Seller’s address without undue delay, no later than 14 days from the day of informing about withdrawal.
- The Consumer bears the direct costs of returning the Product, unless the Seller decides otherwise.
- The Consumer is liable only for diminished value of the Product resulting from use beyond what is necessary to establish its properties and functioning.
- The right of withdrawal does not apply, among others, to non-prefabricated products made according to the Consumer’s specifications, sealed goods that cannot be returned after opening for hygienic reasons, recordings and software in sealed packaging after opening, subscriptions, delivery of digital content started with the Consumer’s consent before the withdrawal period expires, etc.
- If payment was made by card, the Seller will refund to the account assigned to the card.
- Order processing time is counted from successful payment authorization.
- Complaints and warranty
- The Seller delivers new Products free from defects.
- In case of a defect the Customer has the right to pursue claims under statutory warranty (rękojmia) provided in the Civil Code. In relation to Entrepreneurs the parties may exclude liability under statutory warranty.
- Complaints should be submitted in writing or electronically to the addresses given in §3 of the Terms or via the complaint form provided in the Store.
- The complaint should describe the defect, the circumstances of its occurrence (including date), Customer data and the demand arising from the complaint.
- The Seller will respond to the complaint without undue delay, and where the Customer is a Consumer — no later than within 14 days; failure to respond within this period shall mean the complaint is considered justified.
- Goods sent under complaint should be directed to the address given by the Seller.
- If the Product is covered by a guarantee, information about its terms will be included in the Product description in the Store.
- Out‑of‑court complaint handling and claims
- Information on possibilities for Consumers to use out‑of‑court dispute resolution methods is available at the offices and websites of district (city) consumer advocates, consumer protection organizations and Regional Trade Inspection Offices and at the Office of Competition and Consumer Protection.
- A Consumer may apply, among others, to a permanent consumer arbitration court or to the regional inspector of the Trade Inspection with a request to initiate mediation proceedings.
- A Consumer may also use free assistance of a consumer adviser or a social organization (e.g. Consumer Federation, Association of Polish Consumers).
- Personal data in the online Store
- The administrator of personal data provided when using the Store is the Seller. Detailed information on data processing is included in the Privacy Policy available in the Store.
- Personal data are processed to fulfill orders (legal basis: performance of the contract) and, with Customer consent, for marketing purposes.
- Recipients of data may include carriers and entities handling electronic payments.
- The Customer has the right to access and correct their data.
- Providing data is voluntary, but failure to provide data necessary to fulfill the order prevents conclusion of the Sales Agreement.
- Final provisions
- Contracts concluded through the Store are concluded in Polish.
- The Seller reserves the right to change the Terms for important reasons (changes in law, payment and delivery methods). The Seller will inform Customers about changes at least 7 days in advance.
- Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act on Provision of Electronic Services, the Consumer Rights Act and data protection regulations.
- The Customer may use out‑of‑court methods of complaint handling and claims via the EU ODR platform: http://ec.europa.eu/consumers/odr/.
